Volume II - Laws of Cornwall County

Chapter 1 - Official Language

The official language of our Kingdom is English.
All other languages are prohibited.

The first two times someone is seen/heard speaking a language other than English (on the official forum), they will receive a warning by mail (in game) and his/her post will be deleted.
If two warnings are not sufficient, the accused will be put in trial and will face punishments.

Violation of this may be punished with a fine, not exceeding the limits set out by the King in Concerning Punishment (Book III, Chapter 2).


Chapter 2 - Witchery

Edicted in holy year MCDLXIII by his majesty, the King of England , who holds them from the Lord.

Whosoever shall dare to create several accounts and take a financial advantage of that, shall respond for the offense of witchery in front of the Holy Inquisition Tribunal. If found guilty, his/her clones are to be burned alive in a public place. The accused will pay a very heavy fine, and will be pilloried for up to several days. In case of repetition of the offense, or well-known abuse, the accused will be hanged by the neck until dead.

Conviction of Witchery shall always be referred to the HRH LongJohnSilver, the King of England, for verification. The guilty witch shall receive harsh punishment, with no limits save those edicted by the King in Concerning Punishment (Book III, Chapter 2).

Chapter 3 - Economic Manipulation - In effect as of 14/4/1456

i. General terms:
In general, Economic Manipulation is any action, or attempted action, that would subvert or endanger the economy of Cornwall.

Economic Manipulation includes but is not limited to:
Speculation
Economic Monopolization
Pricing Violations
Hoarding

The crimes of Economic Manipulation may be cumulative and may be punished with a fine and/or with jail time, not exceeding 3 days or the limits set out by the King in Concerning Punishment III;2.

ii. Speculation:
Taking advantage of the economy for the unreasonable personal gain of one's self or others. This also includes actions to harm others, even if there is no direct benefit to one's self.

This includes buying items and reselling them within 5 days on the same market, at prices exceeding the original purchase price. The council grants recognized TA's the right to amend the period of time as their town requires. The Mayor must inform the Count(ess) of the amended time period and include the change in the list of town regulations.

Town and County agents are granted an exemption to this for markets within their jurisdiction, provided that it is done as part of an established policy of the TA or the Council.

iii. Economic Monopolization:
Creating or abusing a monopoly for personal gain.

Creating a monopoly in the County of Cornwall is illegal. You may NOT buy any or all items of a certain good while selling the same item. If there is none of an item offered on the market, it is permissible to offer items within a normal price range, or no more than 25% above the published Cornwall County sell price. However, you may not buy items and resell them within 5 days on the same market at prices exceeding the original purchase price (Ex. After purchasing a knife from the town market at a certain price, you must wait 5 days to sell a knife from your inventory at a higher price).

The council grants TA's the right to amend the period of time as their town requires. The Mayor must inform the Count(ess) of the amended time period and include the change in the list of town regulations.

Town and County agents are granted an exemption to this for markets within their jurisdiction, provided that it is done as part of an established policy of the TA or the Council.

iv. Pricing Violations:
Some goods have limits on the offer prices. They are listed as:
A. Wood
may NOT be priced at the prices of 8.05; 12.05 and 15.95 without authorization of the town and/or county who runs the market.
B. Corn
May not be sold above 4.00/bag
C. Bread
May not be sold above 8.00/loaf
Exception: This does not include prearranged deals to give/loan a player money. The seller must retain proof of the deal between the parties for five days following the transfer.

v. Hoarding:
At times council may declare a good to be in shortage in Cornwall. When this is done, Council will also set a limit on how many units of that good can be purchased per person per day.

The Council grants TA's the right to declare a shortage in their town, as the town requires. However, the Mayor must clearly set out the limits on the goods and must inform the Count and the council Trade Minister of the shortage. A TA-declared shortage is limited in length to a maximum of 72 hours. At the request of the Mayor, the County Council may vote to extend the length of a TA-declared shortage by as many as 30 days.

Chapter 3 - Fraud - No longer in effect as of Reset 17/4/1456
i. General terms:
In general, fraud is any action, or attempted action, that would subvert or endanger the economy of Cornwall.

Fraud includes:
Economic Manipulation
Economic Monopolization
Pricing Violations
Hoarding

ii. Economic Manipulation
Taking advantage of the economy for the unreasonable personal gain of one's self or others. This also includes actions to harm others, even if there is no direct benefit to one's self.

This includes buying items and reselling them within 48 hours on the same market, at prices exceeding the original purchase price. The council grants recognized TA's (IV,3) the right to amend the period of time as their town requires.

Town and County agents are granted an exemption to this for markets within their jurisdiction, provided that it is done as part of an established policy of the TA or the Council.

iii. Economic Monopolization:

Chapter 4 - Trade Regulations

All persons shall have the right to sell goods on any local market inside the borders of Cornwall as long as they comply with the terms of Volume II, Chapter 3 of Cornwall law. All persons shall have the right to purchase goods on any local market inside the borders of Cornwall or County Fair as set forth in this Chapter. Towns of Cornwall shall have the right to regulate the amount of goods purchased on their local market as explicitly set forth in this Chapter.

I - All persons shall have the right to sell any product on any market located within the borders of Cornwall as long as they follow any and all laws of Cornwall pertaining to the sale of goods.

II - All persons shall have the right to purchase any and all goods from local citizens with no limits on the amount of goods purchased except during a declared shortage under Volume II, Chapter 3 of Cornwall law. For this purpose, "any and all goods from local citizens" shall be defined as those goods for sale on the market ending in a price of '0' or '5' (ex: 3.90 or 14.95, etc.).

III - All Cornish citizens shall have the right to purchase any and all Town Hall goods from the Town in which they live, except where restricted by other laws (eg shortages or economic manipulation). For this purpose, "Town Hall goods" shall be defined as those goods for sale on the market ending in a price other than '0' or '5' (ex: 3.91 or 14.96, etc.).

IV - Any person wishing to purchase "Town Hall goods" in a town other than the one in which they live may only do so if issued a written Trade Contract by the Mayor or the Minister of Trade for that town.

V - A Trade Contract must clearly state the specific good(s) to be purchased and any limitation on how many of that good can be purchased.

VI - Mayors and authorized Ministers of Trade shall have full authority to determine which town hall goods will be made available though Trade Contracts, however such goods are to be made available to anyone requesting a Trade Contract without discrimination except as defined in section IV of this law. Trade within Cornwall should be encouraged as trade stimulates local economies, but care should be taken to balance the needs of local citizens as well.

VII - Malicious discrimination based on race/ethnicity, *zensiert by Forum*/gender identity, age, religion/spirituality, sexual preference/orientation, nationality/town of residency, socio-economic status, political affiliation, or disability in issuing Trade Contracts by a Mayor or Minister of Trade shall constitute an Abuse of Power under Volume II, Chapter 12 of Cornwall Law.

VIII - Any person who violates the terms of a written Trade Contract on 3 occasions within a 6 month period anywhere in Cornwall loses the privilege of establishing Trade Contracts. The individual may still request Trade Contracts, but they will be granted solely at the discretion of the town's Mayor.

IX - Punishment for Chapter 4, charged as Fraud ingame:
1st offense: 25 pounds or 10% of the value of the goods bought, which ever is greater.
2nd offense: 50 pounds or 10% of the value of the goods bought, which ever is greater.
3rd offense: 100 pounds or 10% of the value of the goods bought, which ever is greater.
4th and beyond offense: Crimes may be cumulative, and may be punished with a fine and/or with jail time, not exceeding 3 days or the limits set out by the King in Concerning Punishment III;2

Summary
Any person can purchase any item off any market in Cornwall ending in a price of "0" or "5".

Any citizen of a town can purchase any item from their own town market, even if it does not end in "0" or "5".

All persons visiting a town in Cornwall must contact that towns Mayor and/or Minister of Trade to enter into a Trade Contract BEFORE purchasing items ending in a price OTHER than "0" or "5". Otherwise, you MAY NOT buy items ending in a price OTHER than "0" or "5".


Chapter 5 - Minimum Wages and Slavery

The right to establish a minimum legal wage shall be left to the town assembly of each town and city to enforce within the confines of their borders.

1. The County of Cornwall will establish the wage for all positions within its control (mines, militia, etc.…). Laws establishing wages for County work will not fall under the laws set by any Town or City.
2. Criminals who are sentenced to work community service such as working in the mines, Inter-County Minimum Wage or producing goods for the County as alternative penalties to fines or jail time shall be exempted from this law for the duration of their sentence and only for purposes of fulfilling their sentence.
3. Slavery is considered a Light Crime and may be punished with a fine, in accordance with Concerning Punishment (Book III, Chapter 2).

Chapter 6 - Treason

Treason includes high treason and lower treason. High treason includes crimes against the lord, the King, the Royal Family or their representatives. The representatives are the Dukes, and Duchesses of the counties, and any person on official, public business for the King and/or his family. Lower treason shall include crimes against the people of Cornwall, and/or England, or the representatives of the people. These representatives are the persons elected to the posts of Mayor and County Council member.

I - High Treason:

Defined as any act that goes against the will of Jah and his direct representative on Earth, the King.
Examples:
*Subverting, or attempting to subvert, the power and/or authority, of HRM LongJohnSilver, the king of England; of the Royal Family; or their appointed representatives, namely the Duke or Duchess of the county.
*Attacking and/or injuring any member of the Royal Family, or their appointed representatives.
* Raising an army against the King, or the County or Cornwall.

II Low Treason:

Defined as any act that goes against the expressed will of the People of Cornwall and/or England
Examples:
*The attempt or successful attempt to remove any person who holds an elected office, including Mayor, or County Council Member, without following due process, specifically an election or a council-sanctioned revolt.
*Aiding in the attempt to remove any person from elected office, without following due process, specifically an election or a council-sanctioned revolt.
*Any criminal action of which the direct result is the death of any person in the County of Cornwall (OOC: A player leaves the game as a direct result of your actions)
* Being a member of an army against the people of Cornwall.

IV Exceptions:
The King, Royal Family, Count and a vote by Council may waive this law. Such an act must have PRIOR consultation with the County and town(s) affected. These may be done in private, or public, and produced, if required, after the acts have been committed. The waivers must be explicit as to what clauses are being waived, and in what regions. If the waiver does not explicitly state this information, than the broadest interpretation of the waivers shall be understood.

V Punishment-

Treason is to be considered a Serious Crime. The traitor may be punished with a fine with jail time not exceeding 3 days or death, subject to the limits set out by the King in Concerning Punishment (III,2). The crimes of treason may also cross into the Special Offenses the King mentions in (III,2,ii).

Chapter 7 - Robbery and Attempted Robbery
Whosoever shall commit robbery against a person or organization and steal his/her wages, or property shall be charged with robbery. If he/she kills the victim, he/she will also face the charge of murder.

Whosoever shall attempt robbery against a person or organization shall be charged with attempted robbery.

Robbery and Attempted to Robbery can punished with a fine and/or with jail time, not exceeding 3 days or the limits set out by the King in Concerning Punishment (III,2). In some cases, armed robbery and/or pillage of the public purse may be considered as special offenses, and punished under the guidelines of that section of the Edict (III,2,ii)

Chapter 8 - Contempt of Court/Obstruction of Justice
i Contempt of Court
Whosoever is called in front of the Court and fails to show in the Court, treats the Court or its participants with disrespect, interferes with its actions, or otherwise mocks the Court shall be guilty of Contempt of Court.

ii Obstruction of Justice
Whosoever intentionally stops the arrest of a criminal or prevents a witness from appearing in this county, provides false testimony, and/or withholds testimony shall be charged with Obstruction. (Foreign persons may give testimony in their native tongue, but must provide an accurate translation into English, as well as the testimony in their native language.)

If found guilty, the defendant will face the punishments for Moderate or Serious Crimes, or the same punishment as the crime of which the criminal was trying to get someone falsely convicted or acquitted of, whichever is greater. Penalties and Maximum punishments are specified under the Concerning Punishment section of the laws (Book III, Chapter 2).

Lawyers recognized by the Court and the Defendant may add comments in English to help the case which they support. They are bound by the same contempt rules.

Chapter 9 - Cornwall Tavern Legislation
I - Tavern owners must respect local price caps, including the county pricing restrictions as specified in Volume II, Chapter 3 (iv) of the Laws of Cornwall County, and not exceed them when creating a menu.

II - Tavern owners have the right to create meals and set prices at their discretion, as long as their menu does not mislead their patrons.

III - Tavern owners may not charge for an empty menu item.

IV - Tavern owners may not have discrepancy between the advertised menu item and the actual content of the meal (i.e. meat must be meat, fish must be fish, etc.)

V - Tavern owners may not create and advertise a menu that IG mechanics prevent from working as advertised. Max stats from a tavern menu is 3, when a 1 stat item is placed first and a 2 stat item second. Attempts to add further items will not result in stats for the patron and is misleading.

VI - Tavern owners who fail to deliver the announced meals shall receive one warning to replenish their stock or remove the items from the menu, and proof of this has to be sent to the official in charge (the local mayor or the county public prosecutor). If the owner fails to do this then he will be charged with the offense of Fraud.

VII - It is illegal to force a bartender to serve against his/her will. The offending Tavern Owner may be prosecuted for Slavery.

VIII - Inactive taverns are defined as taverns where the owner and bartender are both dead, in retreat or out of town for at least 14 days, or taverns that fail to pay taxes on more than one occasion, or are out of food for a period exceeding 14 days and are still offering menus. All owners and bartenders of 'Inactive taverns' shall be sent a message IN GAME when they have been deemed inactive. They have 3 days to become active, or the King will be asked to shut the tavern down.

IX - Violations of the Tavern Law can be punished with a fine and/or with jail time, not exceeding 3 days or the limits set out by the King in Concerning Punishment (III,2).

Chapter 10 - Harassment
Any person or persons who conspire(s) to intimidate, frighten or anger another without provocation or with maliciousness of intent shall be guilty of harassment.

I. Definition of Harassment
a. The act of causing distress to another person through words or actions after being warned that one’s words or actions have caused distress. This can include the use of foul language, comments that are considered insulting or provocative within one’s immediate surroundings, threatening or malicious comments directed at one or more persons, or any action designed to create an environment of hostility or repression.

II. Forms of Communication to be encompassed
a. All forms of communication within the county's jurisdiction shall be covered by this law including but not limited to speech in a public forum (this includes taverns and scroller) and speech in a private forum (including mail and instant messaging by the nobility). This includes communication sent from another county to a person or persons currently within the county limits of Cornwall and communication sent to a person in another county by a person or persons within the county limits of Cornwall.
b. Any attempt to subvert this law using unlisted forms of communication for the purposes of harassment shall be considered to be covered in the previous article (2A).

III. Penalties for Harassment
a. Harassment shall be considered a serious or infamous crime at the discretion of the judge with the death penalty being an option for repeated offense. Penalties and Maximum punishments are specified under the Penal Code of Cornwall County (Book III, Chapter 2).
b. All harassment cases shall also be reported, by the public prosecutor, to the King for possible further sentencing.

Chapter 11 - Betrayal
Defined as an act which breaks the person, or organization’s word, or agreements, or is a violation of the trust shown in a person by another or by an organization.
It includes:
*Opposing an Official representative of Cornwall, to the detriment of any persons or towns in the County of Cornwall. This includes single persons, and groups that represent the county. This does not include debates or discussions and is therefore limited to actions only.
*Passing security information to any-person, for any reason, without the expressed, written consent of the person(s) who are the subject(s) this information.
*Aiding in resisting an Official Representative of the County.
*Endangering the persons, as individuals or a collective, of any Town in Cornwall, or the whole of Cornwall.
*Breach of an agreed upon contract between people or organizations. The violated party must hold an exact copy of the agreement and proof that there was an agreement made by both/all parties, and the requirement for this to be produced upon request, is laid on the violated party.

Punishment-
Betrayal is a serious crime, and is to be punished with a fine and/or with jail time, not exceeding 3 days or the limits set out by the King in Concerning Punishment (III,2). In cases where an accord or contract was breached, and that text outlines the punishment for violation, the contract's clause shall be considered in handing down a punishment.


chapter 12 - Abuse of Office
Defined as the abuse or attempted abuse of any public office, including:

*Seeking to hold any public office for the purpose of breaking any Law, or to aide in breaking any law.
*Seeking, or using the powers of, any office, elected or otherwise, to defend oneself against prosecution in this or any other county.
*Gaining any office, elected or otherwise, for the purpose of harassing another citizen or subject of England.
*Gaining or using any Office to deliberately cause detriment to any person or organization, for malicious reason
*Using the powers of any office, elected or otherwise, for personal gain, or the personal gain of friends, family or organizations.
*Not attempting to fulfill the requirements of any office, elected or otherwise, to which one has chosen to accept. If one is unable to fulfill the requirements of office, one is expected to resign in a timely fashion.

Punishment-
Abuse of office is a serious crime, and is to be punished with a fine and/or with jail time, not exceeding 3 days or the limits set out by the King in Concerning Punishment (III,2).

Volume III - Procedures


Chapter 1 - Voting Procedures

Chapter 1 – Proposals, Discussions

Any council member may initiate a proposal by opening a discussion thread with the string ' [discussion] ' at the beginning of the Subject field of a thread. The member doing so is considered the originator of the discussion.

This will last as long as needed.

Chapter 2 – Voting Requirements

i The originator of the discussion will open a vote, or the count may open the vote after a minimum of 72 hours from the time it was posted for discussion.

ii The standard vote options will be Yea(in favor), Nay(Against), and Abstain(With reasons, preferably). If the vote requires, the options can be changed as needed. By voting, members of the council waive the right to object to the changed options, and show support for the outcome of the voting. If 7 or more members vote, the non standard options will be seen as having the support of the council, and will be considered a legal vote.

iii Should the occasion occur that both the originator and the count are both unable to propose legislation for the vote due to death, illness, or other disabling event, for a period of more then 48 hours, any councilor may step in to fill the breach for purposes of writing and proposing the aforesaid legislation.

iv The vote lasts for 48 hours, or until a majority of the council has pronounced in favor of a specific option, which ever comes first.

v If a councilor is replaced mid vote, the replacement may only vote on a law, policy, etc. if his predecessor hadn’t. Any vote that is not resolved before council enters into transition (following due process) between elections must be restarted after the new council has been granted access to council chambers.

vi All councilors must post which way they are voting or their vote is nullified.

Chapter 3 – Voting Limitations

i Any Council votes relating to changes in [Volume III - Voting Procedures] require a 2/3 majority of those voting Yea(In favor) or Nay(Against) to pass. All other council votes, unless specified, require a simple majority of those voting (not counting Abstain votes) to pass.

ii No change to any crime may come into effect sooner then the reset after 24 hours from the publication.

iii If a vote fails, a reworded proposal may be tried immediately.

iv If the vote had the potential to change a law, the spokesman shall post the voting within two days.

v If a reworded proposal under [Volume III, Chapter 3, Article iii] is being tried the announcement of the vote shall be postponed until after the vote.

Chapter 2 – Penal code

Concerning Punishment
The County of Cornwall has heard and accepted the King's Edict regarding Justice, and follows it as a guideline for punishment. The judge's abilities are used to best judge the proper punishment for a crime. A judge may also order any of the following, in place of or in concert with a fine and/or jail time.

• Public apology to the victim(s).
• Public service as work in the mines, or the militia.
• Repayment to the victim(s) though money or services, in consideration for a reduced fine.
• Payment to the County in consideration for a reduced fine.

HRH LongJohnSilver, our King, states:



A judge may always impose a fine, the amount to be at the judge's discretion, and/or a prison term of not more than three days for all infractions. For the most serious cases, or for blood crimes, a judge may pronounce a death sentence on a character, resulting in a 10-point loss to all their characteristics. If possible, this should be done with the consent of the condemned for RP reasons, or if the condemned has abandoned the game.

III,2,i: Really real offenses

These are basically the real-life offenses, that real-life justice applies to, and that involve systematic eradication of the character, as well as resorting to real justice, if the gravity is deemed sufficient by the administrators.
• insults and other verbal attacks
• cheating and exploiting bugs or loopholes
• account hacking and password theft

III,2,ii: Special offenses

Special offenses are those that, due to their serious effects on game equilibrium or the interests of the RK, may be punished by a prison sentence greater than three days:
• Accused level 0/1 : 3 days maximum
• Accused level 2 : 6 days maximum
• Accused level 3 and up : 10 days maximum

(Warning: Any judge exceeding these prison sentences will be prosecuted themselves!)
The special offenses are:

witchery and multiple accounts

abusive large-scale speculation and pillage of the public purse

blood crimes and armed robbery

Rules for the Courtroom


Bill of Indictment

The Public Prosecutor is responsible for filing Bills of Indictment against any individual who has violated Cornwall law. The Mayor of a Town is responsible for filing Bills of Indictment against any individual who has violated Town Regulation.

A Bill of Indictment contains the defendant's name, place of residence, the charge against the defendant, the law violated, and possible punishment by law for the charge.


Prosecutor Indictment

The Prosecutor's Indictment is the argument or main evidence the Public Prosecutor or Mayor presents to the Court, usually after witnesses have made their statements. All evidence and arguments by the Prosecution must be made in the Prosecutor Indictment. The Prosecution may recommend a sentence to the Judge in the Prosecutor Indictment, but it is up to the Judge to decide guilt or innocence and to sentence the defendant if found guilty under the laws of Cornwall and proclamations by HRH the King.

Defense
The defense is entitled to a lawyer in all cases against him or her. To obtain a lawyer, the defense must notify the Judge by in game mail who he wishes to obtain as a lawyer or ask the Judge to appoint one from the Law Society of England. The Judge will suspend the trial until a lawyer is obtained for the defense. The defense has a right to dismiss the Court appointed lawyer at any time in the case and proceed without a lawyer or obtain a lawyer independently. The defense must inform the Judge by in game mail that such action has been taken.

The defense must act appropriately in the Courtroom and be respectful of the Judge, Officers of the Court, citizens in the Courtroom, Witnesses, and must obey all Judge's orders. The Judge may order the Public Prosecutor to file Contempt of Court charges at anytime or the Public Prosecutor may file Contempt of Court charges at their discretion if contempt of the Court has been displayed.

The defense has a right to appeal his or her case to the Court of Appeals for England following the guidelines of the Court of Appeals.

The defendant is encouraged to participate in role play as much as possible as it adds an interest and entertainment value to the game. A defendant who role plays his or her actions and defense well may been seen in a more positive light by the Judge and Public Prosecutor. A more lenient charge or sentence could be given by the Public Prosecutor and Judge at their discretion should the defendant show good role play rather than just complaining about the charge, having to come to Court, etc. This would be considered "good behavior".


Witnesses

The defendant and prosecution may call up to 2 witnesses in game and in the forum courtroom. The witnesses must be the same in both places. At the Judge's discretion, the witnesses may be questioned by the defendant or lawyer, or by the Prosecution. Also, the defendant and prosecution may make a motion to call more witnesses in the forum courtroom which will be at the Judge's discretion to allow such motion if a matter needs to be cleared up more. If such witnesses are allowed by the Judge, the Judge must reference the courtroom forum link in his in game Judgment.


Order of testimony

The following order will be strictly adhered to in game and forum courts:

1. Bill of Indictment
2. Defendant's first statement
3. Witnesses statements
4. Prosecutor's indictment
5. Defendant's second statement
6. Judge's decision

The only exception to the above are motions to the Court. The same statements and testimony given in game court must be given in forum court.


Courtroom

The Public Prosecutor or Mayor is responsible for opening up a RP courtroom in Cornwall Inn. The subject of the Courtroom would be "[IGRP] Cornwall vs. (name of defendant & place of residence) court proceeding, (date)" This RP courtroom is for added game play and role playing opportunities. Defendants, Witnesses, the Public Prosecutor and Judge all are encouraged to participate in the RP Courtroom. The Judge is responsible for decorum in the Courtroom and his instructions and orders must be obeyed. Any violation of Judge's order may result in a charge of Contempt of Court or the Judge closing down the Courtroom. Any actions or statements in game or forum Courts become public record and as such may cause additional charges to be filed.

The Judge may ask the defendant or prosecution questions at the Judge's discretion to clear up any matter.

Objections are the only exception to statements to the Court. Once an Objection is posted, no one may speak in the courtroom until the Judge hears the objection, and the Judge determines if it is sustained or overruled. All Objections must also be PM'd to the Judge at the time of it's posting.

The Judge reserves the right to strike anything from the record. However, this must be done by quoting the part to be struck and saying so.

Citizens of Cornwall may enter the forum Courtroom but may not make any statements to the Court except to Role Play their actions such as their arrival in the Courtroom, etc. The Judge has the right to ask for order in the Courtroom and if such orders are not obeyed, then in game charges of Contempt of Court may be filed against anyone sitting in the Courtroom.

Evidence presented before the Court must be historical in nature. (OOC: Cameras, crime labs, DNA, etc. were not invented yet) Evidence must be presented by testimony only or in the case of a screen shot, it must be some evidence that you can physically hand to the Judge such as a bill of sale, a letter, etc. Screen shots that are of a capture of time such as a conversation in a Tavern, an event such as a revolt, robbery, etc. will not be allowed as they can not be physically handed to the Judge. Eyewitness testimony will be satisfactory evidence in such cases. The Judge must weigh and determine the credibility of witnesses and defendant in such cases where a screen shot is now allowed. All citizens testifying before the Court must obey this rule.

No editing of posts in a courtroom is allowed. Please take your time with your testimony before the Court and think what you will say as you can not edit your post. Any edited posts will be removed from the record and courtroom by the Judge's order.


Discretion of Prosecution

The Public Prosecutor and Mayor have full discretion to bring charges against an individual. If the prosecution does not feel enough evidence is available to charge someone with a crime, they can choose to not prosecute that individual. Also, the prosecution may choose to handle Slavery laws and Regulations, Fraud laws, and Tavern violation laws out of court.

A plea deal may be made in cases of violation of these laws on the following conditions: 1st offense offender, monetary amount of crime does not exceed 25 pounds in total, and defendant waives his right to a trial by Judge and accepts the conditions on the plea deal.

A plea deal must include: the law/regulation that was violated, the deal from the prosecution on how to rectify the violation which can not include a fine but only restitution to the victim, and a specific time period that the defendant must not commit the same crime again up to 4 months or face a harsher sentencing for a 2nd act of the same crime in violation of the plea agreement.

The Judge must be mailed the agreed upon plea deal and agree to the deal before it can be carried out. If agreed upon, the Judge will file the plea deal in Council Chambers as a record.


Clerk of Court office

The Clerk of Court office is located inside Council Chambers and serves as a record keeping of all court cases. Court transcripts, plea deals, and status of cases are filed in the Clerk of Court office either by the Public Prosecutor or Judge (especially in a Town Regulation case where the Mayor is the Prosecutor).


Courtroom staff

The Judge may appoint any Courtroom staff needed as a part of Role play but must appoint the following positions:

Court Guard
The Judge will consult with the Captain of the CRG and appoint a Court Guard(s). Responsibilities of the Guard(s) is to provide safety and security of the Courtroom and its officers, lead the defendant into Court, brings in witnesses for testimony, announces the presence of the Judge in the Courtroom, enforce the Judge's orders when requested to do so, administering oaths to the defendant and all witnesses, and carrying out any Judge's order in the Courtroom.

Oath - "I pledge to tell the entire truth in my testimony before the Court and understand that any statement of untruth, omission of truthful testimony relevant to this case, or refusing to testify may result in charges being filed against me in this Court"

Court Clerk
The Judge will appoint a Court Clerk whose responsibilities will be sending in game mails to the witnesses to call them to court(OOC: must have the Courtroom link attached to the mail and instructions to notify the Court of your presence), and gathering all statements and evidence of the trial beginning with the Bill of Indictment to the Judge's reading of his sentence and keep a record of that Court case in Cornwall Inn in a single post per case in the Court Clerk's office for record keeping.

All Courtroom staff positions should be placed open at the beginning of the term of Council by the appointed Judge in order to find citizens of Cornwall who are interested in these Courtroom staff role play positions.


Role play crimes on Forum

Any crime committed in Role play in the Jurisdiction of the Cornwall Laws (Cornwall Inn, any Town Hall in Cornwall Inn, Council Chambers, Cornwall Government, or University of Cornwall) may result in the Public Prosecutor filing charges in a RP Courtroom to further Role play in the game. No actual charges in game may be filed for a RP violation of Law that does not occur in game except for such cases mentioned previously for violation of law occurring in a case involving a RP Courtroom of an in game case. Sentences may not be carried out in game nor will past RP crimes be allowed during testimony in future Court hearings in game. These cases are for role play only and the Public Prosecutor should make an attempt to coordinate such role play with the parties involved in the role played crime.

Any violation of these rules of Court will be enforced at the sole discretion of the Judge which may include testimony or evidence not being allowed and stricken from the record (However, this must be done by quoting the part to be stricken and stating the reason and be included in the Court record), instructions to the Public Prosecutor to file additional charges, removal from the Courtroom, locking the Courtroom, etc.
